Arthur’s Brown execution date was withdrawn earlier this month to allow time to review the evidence. On September 1, 2013, a new law went into effect in Texas that allows inmates to file appeals if outdated science was used during their trials to convict them, as our understanding of science continues to grow. Arthur and his team contend that this applies to them. During Arthur’s trial, a ballistics expert testified that the weapons used in the murder of which Arthur was charged were the same weapons found during his arrest, to the exclusion of all other weapons, including similar models. Arthur’s attorneys are arguing that with the advances in testing today, one cannot make such a statement without further testing. Prosecutors have agreed to additional testing. Arthur’s execution has been put on hold until additional testing is completed.
